{"id":112010,"date":"2019-07-01T19:18:28","date_gmt":"2019-07-01T23:18:28","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=112010"},"modified":"2019-07-01T19:18:28","modified_gmt":"2023-08-17T18:43:29","slug":"saf-calguns-and-partners-asking-injunction-against-age-based-gun-ban","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/saf-calguns-and-partners-asking-injunction-against-age-based-gun-ban\/","title":{"rendered":"SAF, Calguns and Partners Asking Injunction Against &#8216;Age Based Gun Ban&#8217;"},"content":{"rendered":"\n<p><strong>BELLEVUE, WA<\/strong> \u2013 The Second Amendment Foundation and Calguns Foundation are seeking an injunction against a section of California\u2019s penal code that prohibits young adults, ages 18-20 from purchasing or acquiring firearms, and they are asking the federal court to declare this prohibition to be unconstitutional.<\/p>\n\n\n\n<p>Joining SAF and Calguns are\nthe Firearms Policy Coalition, Firearms Policy Foundation, a local business and\nthree private citizens. The lawsuit was filed in U.S. District Court for the\nSouthern District of California. The plaintiffs are\nrepresented by lead counsel John W. Dillon of Carlsbad, California-based Gatzke\nDillon &amp; Balance LLP. A copy of the court filing can be accessed at <a href=\"https:\/\/www.firearmspolicy.org\/legal\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-calguns-and-partners-asking-injunction-against-age-based-gun-ban\" title=\"SAF, Calguns and Partners Asking Injunction Against 'Age Based Gun Ban'\">www.firearmspolicy.org\/legal<\/a>.<\/p>\n\n\n\n<p>\u201cWe\u2019re\ngoing to court against this law because it clearly violates the Second and\nFourteenth amendment rights of young adults,\u201d said SAF founder and Executive\nVice President Alan M. Gottlieb. \u201cWhen a citizen turns 18 years old in this\ncountry, he or she is considered a legal adult, free to exercise their rights\nunder the Constitution, and that certainly should include the Second Amendment\nright to keep and bear arms. <\/p>\n\n\n\n<p>\u201cBut\nthis California law turns that concept on its ear, with very few exceptions,\nsuch as possessing a valid hunting license,\u201d he added. \u201cBut our individual\nplaintiffs do not hunt, and have no intention of pretending to be hunters, just\nto exercise their constitutional rights.\u201d<\/p>\n\n\n\n<p>The\nlaw in question is Penal Code 27510, an onerous regulation that prohibits\nlicensed dealers from selling, supplying or delivering firearms to any person\nunder age 21.
