BELLEVUE, WA<\/strong> \u2013 A federal judge has denied a motion to dismiss a lawsuit against the California Department of Justice and Attorney General Xavier Becerra over the state\u2019s failure and refusal to establish a properly functioning internet-based firearms registration system that was mandated by law.<\/p>\n\n\n\n

U.S. District Judge\nMorrison England, Jr., a George Bush appointee, denied the motion, noting in\nhis 10-page ruling that, \u201cthe Supreme Court specifically recognized that a\nviolation of procedural due process occurs when \u2018it is the state system itself\nthat destroys a complainant\u2019s property interest, by operation of law,\u2019 whether\nthe state\u2019s action \u201cis taken through negligence, maliciousness or otherwise.\u201d<\/p>\n\n\n\n

\u201cWe\nsaid at the start of this legal action and we still maintain that the state\u2019s\nsystem was like a bad version of \u2018Catch-22\u2019,\u201d noted SAF founder and Executive\nVice President Alan M. Gottlieb. \u201cThe government required registration by a\ncertain deadline, but the online registration failed and people couldn\u2019t\nregister. It\u2019s simply not acceptable when the government mandates something and\nthen doesn\u2019t provide the tools for the public to comply, making them criminally\nliable and subject to firearms confiscation.\u201d<\/p>\n\n\n\n

Judge\nEngland noted in his ruling, \u201cWhile Defendants appear to blame the individual\nPlaintiffs for waiting until the last minute to attempt to register their\nfirearms (seven waited until the last two days of the online registration\nperiod), the fact that Defendants\u2019 website used a dramatic \u2018countdown clock\u2019\nshowing the number of weeks, days, hours, minutes and seconds elapsing until\nthe deadline at least arguably supported a belief that registrations could be\nboth processed and accepted \u2018until literally the last second of the\nregistration period.\u2019 Particularly when coupled with the documented systemic\nfailures outlined above, the countdown clock also supports an inference of\ndeliberate indifference.  <\/p>\n\n\n\n

SAF\nis joined in the case by the Calguns Foundation, Firearms Policy Coalition,\nFirearms Policy Foundation, Madison Society Foundation and seven individual\nplaintiffs.<\/p>\n\n\n\n

\u201cAttorney General\nBecerra and his DOJ had one job to do: Provide a functional system for gun\nowners to use in registering their eligible firearms,\u201d added Firearms Policy\nCoalition President Brandon Combs. \u201cBut instead of doing their jobs, they\ncreated a huge new mess for law enforcement and put innocent people and\nlawfully-owned property at serious risk.\u201d<\/p>\n\n\n\n

\u201cThe state of California couldn\u2019t even build a working system to respect gun owners\u2019 rights,\u201d noted Calguns Foundation Chairman Gene Hoffman. <\/p>\n\n\n\n


The case, known as Sharp v. Becerra<\/em> was filed in U.S. District Court for the Eastern District of California.<\/p>\n\n\n\n
