{"id":111400,"date":"2019-06-18T11:15:52","date_gmt":"2019-06-18T15:15:52","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=111400"},"modified":"2019-06-18T11:15:52","modified_gmt":"2023-09-05T23:41:40","slug":"dems-handgun-purchaser-licensing-act","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/dems-handgun-purchaser-licensing-act\/","title":{"rendered":"Dems Introduce Permit-to-Purchase Bill for All Handguns"},"content":{"rendered":"\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"765\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/GunLicensing-1024x765.png\" alt=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\" class=\"wp-image-111404\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/GunLicensing-1024x765.png 1024w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/GunLicensing-150x112.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/GunLicensing-400x300.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/GunLicensing-768x574.png 768w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/GunLicensing.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>(<em>Photo: John Hopkins<\/em>)<\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Last week, Democrats in both the House and Senate introduced the \u201c<a href=\"https:\/\/www.congress.gov\/bill\/115th-congress\/house-bill\/5490\/text\" target=\"_blank\" class=\"clickTracking\" campaign=\"dems-handgun-purchaser-licensing-act\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\">Handgun Purchaser Licensing Act.<\/a>\u201d It is exactly what it sounds like in that it would push states and municipalities to require purchase permits for all handguns. &nbsp;<\/p>\n\n\n\n<p>Specifically, the bill would establish a federal grant program to incentivize state and local governments to create a permit-to-purchase (PTP) law. &nbsp;<\/p>\n\n\n\n<p>In order to qualify for those federal dollars, the state\u2019s PTP law would need to satisfy all of the following mandates:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The applicant must be at least 21 years old<\/li><li>The applicant must apply for the permit via a law enforcement agency in their state of residency<\/li><li>The applicant must pass a background check<\/li><li>The applicant must provide fingerprints and a photograph. &nbsp;<\/li><\/ul>\n\n\n\n<p>The purchase permits would be valid for a period not to exceed five years.&nbsp; After which, they would need to be renewed.&nbsp; The<a href=\"https:\/\/raskin.house.gov\/media\/press-releases\/raskin-van-hollen-introduce-handgun-purchaser-licensing-act\" target=\"_blank\" class=\"clickTracking\" campaign=\"dems-handgun-purchaser-licensing-act\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\"> press release<\/a> for the \u201cHandgun Purchaser Licensing Act\u201d did not mention a fee associated with the PTP process. (But let\u2019s not kid ourselves, states are definitely going to use this PTP scheme as a money-making enterprise.&nbsp; Which is tantamount to taxing a Constitutionally-protected right.)<\/p>\n\n\n\n<p>\u201cThe evidence is clear: sensible handgun laws save lives. All states require licenses to drive a car or hunt or fish \u2013 so why not handguns, which can kill? Requiring a license to purchase a deadly weapon is at least as important as requiring one to drive a car,\u201d said Sen. Richard Blumenthal.&nbsp;<\/p>\n\n\n\n<p>\u201cA bill as basic as encouraging states to adopt responsible handgun licensing should win broad, bipartisan support,\u201d he added.&nbsp;<\/p>\n\n\n\n<p>Supporters of the legislation claim that PTP laws save lives, citing a recent <a href=\"https:\/\/www.jhsph.edu\/research\/centers-and-institutes\/johns-hopkins-center-for-gun-policy-and-research\/_docs\/impact-of-handgun-purchaser-licensing.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"dems-handgun-purchaser-licensing-act\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\">white paper<\/a> published by the John Hopkins Center for Gun Policy and Research. (With a name like that, I\u2019m sure they don\u2019t have a dog in this fight.&nbsp; Cough.&nbsp; Cough.)&nbsp; Homicides per 100,000 people skyrocketed 17-27 percent through 2017 after Missouri repealed its licensing law in 2007, according to the paper. &nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"625\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/MissoruiGraph2-1024x625.png\" alt=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\" class=\"wp-image-111401\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/MissoruiGraph2-1024x625.png 1024w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/MissoruiGraph2-150x92.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/MissoruiGraph2-400x244.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/MissoruiGraph2-768x468.png 768w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/MissoruiGraph2.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>(<em>Graph: John Hopkins<\/em>)<\/figcaption><\/figure>\n\n\n\n<p>The Coalition to Stop Gun Violence applauded the bill, arguing that most Americans want PTP laws on the books.&nbsp;<\/p>\n\n\n\n<p>\u201cRecent polling shows that 77 percent of Americans support requiring licenses to purchase firearms. This legislation is evidence-based, politically popular, and should be supported by elected officials on both sides of the aisle,\u201d said CSGV executive director Josh Horwitz. &nbsp;<\/p>\n\n\n\n<p>\u201cAmerica\u2019s gun violence epidemic is out of control; it is time to focus on life-saving, meaningful solutions like the Handgun Purchaser Licensing Act,\u201d he continued. &nbsp;<\/p>\n\n\n\n<p>For a better statistical understanding of the effect of PTP laws, I reached out to professor John Lott of the <a href=\"https:\/\/crimeresearch.org\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dems-handgun-purchaser-licensing-act\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\">Crime Prevention Research Center<\/a>.&nbsp; While we&#8217;re awaiting his response, in particular to the validity of the John Hopkins white paper, I figured I&#8217;d post this graph detailing the homicide rate in Chicago from 1985-2016.  <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"544\" title=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/Screen-Shot-2017-01-03-at-5.46.24-PM-1024x544.png\" alt=\"Dems Introduce Permit-to-Purchase Bill for All Handguns\" class=\"wp-image-111402\" srcset=\"https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/Screen-Shot-2017-01-03-at-5.46.24-PM-1024x544.png 1024w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/Screen-Shot-2017-01-03-at-5.46.24-PM-150x80.png 150w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/Screen-Shot-2017-01-03-at-5.46.24-PM-400x212.png 400w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/Screen-Shot-2017-01-03-at-5.46.24-PM-768x408.png 768w, https:\/\/gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/Screen-Shot-2017-01-03-at-5.46.24-PM.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>(<em>Graph: The Trace<\/em>)<\/figcaption><\/figure>\n\n\n\n<p>Illinois requires residents to obtain a FOID (Firearm Owners Identification) card, aka a PTP, before they are legally allowed to possess firearms and ammunition.  The FOID system has been in effect for decades. But as one can plainly see, the FOID system is failing to drive down homicides in the Windy City.  Perhaps, PTP laws are not the panacea anti-gunners make them out to be.  <\/p>\n\n\n\n<p>Along with Blumenthal, backers of the bill include Reps. Jamie Raskin (D-MD) and Jahana Hayes (D-CT) and Sens. Chris Van Hollen (D-MD) Chris Murphy (D-CT).  Time will tell if the Handgun Purchaser Licensing Act picks up steam in Congress.
