{"id":110917,"date":"2019-06-03T18:17:38","date_gmt":"2019-06-03T22:17:38","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=110917"},"modified":"2024-08-03T20:54:56","modified_gmt":"2024-08-04T01:54:56","slug":"hunt365-supreme-court-crow-tribe-member","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/hunt365-supreme-court-crow-tribe-member\/","title":{"rendered":"Supreme Court Sides with Crow Tribe Member Who Took Elk Out of Season"},"content":{"rendered":"\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"1000\" height=\"600\" title=\"Supreme Court Sides with Crow Tribe Member Who Took Elk Out of Season\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2019\/06\/hererra.gif\" alt=\"Supreme Court Sides with Crow Tribe Member Who Took Elk Out of Season\" class=\"wp-image-110920\" \/><figcaption><em>Clayvin Herrera won his case before the Supreme Court after being convicted of hunting out of season and without a license.<\/em> <em>(Photo: Clayvin Herrera Facebook)<\/em><\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The Supreme Court has sided with a member of the Crow Tribe in Wyoming who had been charged and convicted with hunting elk out of season and without a license. <\/p>\n\n\n\n<p>Trump-appointed Justice Neil Gorsuch sided with his left-leaning\ncolleagues to argue that an 1868 treaty between the tribe and the U.S.\ngovernment allows members of the tribe to hunt in \u201cunoccupied\u201d lands outside\ntheir reservation. <\/p>\n\n\n\n<p>In 2014, Clayvin Herrera and several other Crow members\npursued a group of elk past the boundary of the reservation and into the\nneighboring Bighorn National Forest. They shot several bull elk and returned to\nMontana with the meat. <\/p>\n\n\n\n<p>The State of Wyoming charged Herrera with taking elk\noff-season or without a state hunting license&nbsp;and with being an accessory\nto the same. <\/p>\n\n\n\n<p>Herrera appealed through both state and federal courts, citing\na portion of an 1868 Treaty that granted Native Americans \u201cthe right to hunt on\nthe unoccupied lands of the United States so long as game may be found thereon,\nand as long as peace subsists among the whites and Indians on the borders of\nthe hunting districts.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/hunt365-joe-rogan-educates-vegan-actor-russell-brand\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-supreme-court-crow-tribe-member\" title=\"Supreme Court Sides with Crow Tribe Member Who Took Elk Out of Season\">Joe Rogan Educates Vegan Actor Russell Brand on Benefits of Hunting<\/a> <\/h2>\n\n\n\n<p>The lower courts rejected Herrera\u2019s argument. They reasoned\nthat, based on legal precedent, Wyoming\u2019s admission into the Union negated the\n1868 treaty between the Crow tribe and the federal government. In addition, the\nlower courts said, the Bighorn National Forest is categorically not \u201cunoccupied.\u201d<\/p>\n\n\n\n<p>In her <a href=\"https:\/\/casetext.com\/case\/herrera-v-wyoming-2\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-supreme-court-crow-tribe-member\" title=\"Supreme Court Sides with Crow Tribe Member Who Took Elk Out of Season\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">majority opinion<\/a>, Justice Sonia Sotomayor reversed the lower court\u2019s decision and argued that a 1999 SCOTUS ruling repudiated the idea that the tribe\u2019s treaty rights had been abrogated when Wyoming became a state. <\/p>\n\n\n\n<p>Quoting that decision, the justice argued, \u201c[T]here is\nnothing inherent in the nature of reserved&nbsp;treaty rights to suggest that\nthey can be extinguished by&nbsp;<em>implication<\/em>&nbsp;at statehood.\u201d<\/p>\n\n\n\n<p>Furthermore, there is not&nbsp;\u201cany evidence in the treaty\nitself that Congress intended the hunting right to expire at statehood, or that\nthe Crow Tribe would have understood it to do so,\u201d Sotomayor said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/hunt365-hunt-moose-with-hovercraft\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-supreme-court-crow-tribe-member\" title=\"Supreme Court Sides with Crow Tribe Member Who Took Elk Out of Season\">Supreme Court Rules Unanimously to Allow Alaska Man to Hunt Moose with Hovercraft<\/a> <\/h2>\n\n\n\n<p>Sotomayor also rejected the idea that a national park should\nbe considered \u201coccupied\u201d land. She stressed that the treaty term \u201cunoccupied\u201d must\nbe interpreted as the Crows understood it, which, according to historical\nevidence, would have meant \u201cfree of residence or settlement by non-Indians.\u201d<\/p>\n\n\n\n<p>Wyoming does retain the power to impose nondiscriminatory regulations\non tribal treaty hunting rights if those regulations are \u201cnecessary for\nconservation.\u201d Sotomayor also granted that some portions of the Bighorn\nNational Forest could be considered \u201coccupied.\u201d<\/p>\n\n\n\n<p>But since much of the Bighorn National Forest does not contain residential dwellings, the court\u2019s decision allows members of the Crow Tribe to hunt without following the rules and regulations imposed on residents of the state.
