BELLEVUE, WA<\/strong> \u2013 A U.S. District Court judge in Tacoma has denied a motion by defendants to dismiss a federal lawsuit challenging Washington State\u2019s gun control Initiative 1639, ruling that law-abiding gun owners and firearms retailers do not have to violate the law and risk punishment in order to challenge infringements of the Second Amendment.<\/p>\n\n\n\n

SAF\nand NRA are joined by two gun dealers, one in Spokane and the other in Clark\nCounty, plus four young adults who are directly affected by provisions of the\ninitiative. <\/p>\n\n\n\n

U.S.\nDistrict Court Judge Ronald B. Leighton handed down the\ndecision<\/a>.<\/p>\n\n\n\n

\u201cThe\nlong delay is over,\u201d said SAF founder and Executive Vice President Alan M.\nGottlieb. \u201cThe important aspects of the motion to dismiss have been denied. Just\nas important, the judge\u2019s ruling treats the Second Amendment as any other fundamental\nindividual right that is constitutionally protected.\u201d <\/p>\n\n\n\n

The\nfederal lawsuit challenges provisions of the controversial, multi-faceted\ninitiative on the grounds that it violates the commerce clause by banning sales\nof rifles to non-residents, and that it unconstitutionally impairs the rights\nguaranteed by the First, Second and Fourteenth Amendments, and Article I\nSection 24 of the Washington State constitution by preventing the sale of\ncertain rifles to otherwise qualified adults under age 21. <\/p>\n\n\n\n

The\n30-page gun control measure was passed in November. Under its provisions, young\nadults under age 21 can no longer purchase semiautomatic rifles of any type or\ncaliber, because they all fall within the overly broad definition of a\n\u201csemiautomatic assault rifle\u201d as contained in initiative language. The measure\nalso requires a 10-day waiting period, so-called \u201cenhanced background checks\u201d\nand a fee to pay for additional paperwork, plus other provisions.<\/p>\n\n\n\n

\u201cOur\nsupporters have been asking for months about the lawsuit\u2019s progress,\u201d Gottlieb\nsaid. \u201cNow we can report that the long wait for a ruling on the motion to\ndismiss is over, and we won the first round. And now the state, and the\ninitiative proponents, are on the defensive.\u201d<\/p>\n\n\n\n
