Like athlete\u2019s foot and shower farts, John Paul Stevens just won\u2019t go away.<\/p>\n\n\n\n

The former Associate Supreme Court Justice is back in the\nsaddle, peddling a new memoir and rehashing the same failed arguments he\u2019s been\nmaking since the historic D.C. v. Heller <\/em>decision\naffirmed the constitutional right to keep and bear arms.<\/p>\n\n\n\n

Stevens claims in a new op-ed<\/a> published in The Atlantic<\/em> that Heller represents \u201cthe worst self-inflicted wound in the Court\u2019s history\u201d and is \u201cunquestionably the most clearly incorrect decision that the Supreme Court announced during my tenure on the bench.\u201d <\/p>\n\n\n\n

The Second Amendment, Stevens argues, guarantees the right to keep and bear arms only to state militias. As evidence, Stevens cites the \u201cunambiguous\u201d text of the Second Amendment along with the 1939 SCOTUS decision United States v.<\/em>\u00a0Miller.<\/em><\/p>\n\n\n\n

In that decision, the Court upheld the indictment of a man\nwho possessed a short-barreled shotgun, writing, \u201cIn the absence of any\nevidence that the possession or use of a \u2018shotgun having a barrel of less than\neighteen inches in length\u2019 has some reasonable relationship to the preservation\nor efficiency of a well regulated militia, we cannot say that the Second Amendment\nguarantees the right to keep and bear such an instrument.\u201d<\/p>\n\n\n\n

The problem, as Justice Antonin Scalia proved in the\nmajority opinion in Heller, <\/em>is that the\ndecision does not limit the right to keep and bear arms to militia purposes,\nbut rather limits the type<\/em> of weapon to which the right\napplies to those used by the militia, i.e., those \u201cin common use for lawful\npurposes.\u201d<\/p>\n\n\n\n

\u201cHad the Court believed that the Second Amendment protects only those serving in the militia,\u201d Scalia wrote<\/a>, \u201cit would have been odd to examine the character of the weapon rather than simply note that the two crooks were not militiamen.\u201d<\/p>\n\n\n\n

In other words, if the court wanted to protect gun rights\nfor only militia members, it would have been enough to say that the two\ncriminals were not members of a militia. Instead, they determined that the\nweapon in question could not be used for military purposes, and thus was not\nprotected under the Second Amendment. Individuals still retain the right to\nkeep and bear arms, but only those arms that could reasonably be used in a\nmilitia (so, like, all of them \u2013 and definitely AR-15s).<\/p>\n\n\n\n

Stevens fails to answer Scalia\u2019s argument. Instead, he\nreiterates the anti-gun talking point that Heller\n<\/em>represented a \u201cradical change\u201d in the law, and not-so-subtly implies that\nall massacres perpetrated since Heller <\/em>could\nhave been prevented if that case had been decided differently. <\/p>\n\n\n\n

\u201cAn amendment to the Constitution to overrule Heller <\/em>is\ndesperately needed to prevent tragedies such as the massacre of 20\ngrammar-school children at Sandy Hook Elementary School on December 14, 2012,\nfrom ever happening again. But such tragedies have indeed happened again,\u201d\nStevens writes.<\/p>\n\n\n\n
