<\/p>\n\n\n\n

What do computers, books, toy guns, Sudafed, and lawn darts have in common? According to anti-gun politicians<\/a> and pundits<\/a>, they\u2019re all more heavily regulated and difficult to obtain in the United States than a firearm.<\/p>\n\n\n\n

False comparisons between firearms and other consumer products are debunked<\/a> every time they\u2019re made, but facts and common sense didn\u2019t stop Spartacus from leading a #socialjustice rebellion, and it\u2019s not going to stop Cory Booker, either!<\/p>\n\n\n\n

The Democratic presidential hopeful and sitting U.S. Senator has stated<\/a> repeatedly<\/a> that toy guns are more heavily regulated in the United States than real guns. Spartacus, Jr., made the same claim<\/a> in his 15-point gun-control policy platform<\/a> last week, but today the Washington Post\u2019s fact-checkers rated his statements as \u201cmostly false.\u201d<\/p>\n\n\n\n

The Washington (com)Post\nhasn\u2019t been a friend to gun owners, but this time they nailed it.<\/p>\n\n\n\n

\u201cThe Consumer\nProduct Safety Commission does not regulate guns, but it does regulate toy\nguns. That does not mean there are \u2018more regulations\u2019 of toy guns than real\nones,\u201d the Post concluded. \u201cFirearms, at just about every level, are highly\nregulated in the United States. Booker is calling for another level of\nregulation, but he can\u2019t suggest toy guns are even more highly regulated.\u201d<\/p>\n\n\n\n

Booker\u2019s argument rests on the fact that the Consumer Product Safety Commission doesn’t ensure that guns are made using \u201csafe\u201d designs. In that sense, he\u2019s right: unlike they do with toasters, bureaucrats in Washington don\u2019t review every Remington bolt-action rifle to ensure it won\u2019t burn down your house.<\/p>\n\n\n\n

But the senator\u2019s proposal is what you might call a solution\nin search of a problem. <\/p>\n\n\n\n

\u201cMy sense is, this is something that is not a material\nfactor in the gun debate,\u201d Eugene Volokh, a law professor at UCLA, told the Post.\n\u201cCertain products are unsafe because of design. Others can be unsafe from\nmisuse.\u201d<\/p>\n\n\n\n

Guns manufacturers aren\u2019t reinventing the wheel. Even the newest firearm designs have been around for decades, and many of these designs have undergone extensive military testing. We don\u2019t need federal regulators to review Mossberg shotguns to ensure they won\u2019t spontaneously combust.<\/p>\n\n\n\n

What\u2019s more, gunmakers are still subject to lawsuits if\ntheir products are defective. Contrary to what anti-gun politicians would have\nyou believe, firearms manufacturers are not exempt from being held accountable for\nbringing a defective product to market. The Post notes, for example, that Remington\nin 2018 settled a lawsuit<\/a> from owners who claimed that a\ndefective trigger mechanism allowed the gun to be fired without the trigger\nbeing pulled. <\/p>\n\n\n\n

The truth is, firearms are one of the most heavily regulated\nproducts in the United States.<\/p>\n\n\n\n

\u201cNo other industry is regulated at the federal, state and\nlocal level to the extent our industry is regulated, which include design and\nperformance standards,\u201d Mark Oliva, a spokesman for the National Shooting\nSports Foundation, told the Post. \u201cThe federal agencies that regulate the\nindustry include ATF, FBI, State Department, Commerce Department, IRS and the\nU.S. Fish and Wildlife Service.\u201d<\/p>\n\n\n\n

Calling for consumer oversight of firearms isn\u2019t about protecting Americans. It\u2019s about regulating firearms out of existence. As this 1999 New York Times<\/a> article pointed out, \u201cAny rational regulator with that authority would ban handguns.\u201d Regulators could also, as they did in California, require manufacturers to include “safety” features that don’t actually exist, like microstamping and “smart guns.”<\/p>\n\n\n\n

Toy guns aren\u2019t more heavily regulated than firearms, but if Booker gets his way, firearms won\u2019t need any regulation because they won\u2019t exist in the consumer marketplace.<\/p>\n\n\n\n
