(<em>Photo: Office of Councilman Corey O&#8217;Connor: Pittsburgh District 5 Facebook<\/em>)<\/p><\/div>\n<p>You\u2019ve gotta give them points for creativity.<\/p>\n<p>The all-Democratic Pittsburgh City Council <a href=\"https:\/\/www.post-gazette.com\/news\/politics-local\/2019\/04\/02\/Pittsburgh-city-council-final-vote-gun-control-bills-assault-weapons\/stories\/201904020089\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\" target=\"_blank\" rel=\"noopener\">voted 6-3 this week<\/a> to ban the \u201cuse\u201d of some semi-automatic rifles along with a total ban on magazines capable of holding more than ten rounds of ammunition and all &#8220;armor-piercing&#8221; ammunition. The Council also voted to enact an ordinance allowing the court to seize firearms under an \u201cextreme risk protection order\u201d requested by a family or household member.<\/p>\n<p>The council had previously considered a total ban on all \u201cassault rifles,\u201d but as GunsAmerica <a href=\"https:\/\/www.gunsamerica.com\/pittsburg-mayor\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\">reported<\/a> at the time, the Pennsylvania state legislature prohibits local municipalities from passing ordinances that contradict state law.<\/p>\n<p>Pennsylvania law states in <a href=\"https:\/\/www.legis.state.pa.us\/WU01\/LI\/LI\/CT\/HTM\/18\/00.061.020.000..HTM\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\" target=\"_blank\" rel=\"noopener\">18 Pa.C.S.A. \u00a7 6120<\/a>:<\/p>\n<blockquote><p>No county, municipality or township may in any manner regulate the lawful ownership, possession, transfer or transportation of firearms, ammunition or ammunition components when carried or transported for purposes not prohibited by the laws of this Commonwealth.<\/p><\/blockquote>\n<p>Council members believe they can get around the prohibition by banning the \u201cuse\u201d of these firearms rather than the possession. <a href=\"https:\/\/pittsburgh.legistar.com\/LegislationDetail.aspx?ID=3784415&amp;GUID=FB5A2159-21FF-4848-BE1F-99A4F53D873E&amp;Options=ID%7CText%7C&amp;Search=assault+rifle&amp;FullText=1\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\" target=\"_blank\" rel=\"noopener\">The ordinance<\/a> defines &#8220;use&#8221; as \u201cdischarging, loading, brandishing, displaying, pointing or employing\u201d at any \u201cpublic place\u201d (including gun ranges).<\/p>\n<p>\u201cWith state-level preemption in mind, we&#8217;re confident that we&#8217;ve charted a unique course with our shifted focus to \u2018use\u2019 that hasn&#8217;t yet been fully tested in Pennsylvania courts,\u201d Matt Singer, legislative director for Pittsburgh City Councilman Corey O\u2019Connor, told <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/436923-pittsburgh-approves-new-gun-control-regulation-following-synagogue\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<p>\u201cAn example of this change to &#8216;use&#8217; can be seen in Bill 2018-1218, which notes that &#8216;use&#8217; of an Assault Weapon does not include possession, ownership, transportation or transfer,\u201d he added.<\/p>\n<p>Pro-gun advocates have vowed to sue the city to keep the laws from taking effect, according to the <a href=\"https:\/\/www.post-gazette.com\/news\/politics-local\/2019\/04\/02\/Pittsburgh-city-council-final-vote-gun-control-bills-assault-weapons\/stories\/201904020089\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\" target=\"_blank\" rel=\"noopener\">Pittsburgh Post-Gazette<\/a>. The NRA is preparing a suit to challenge the magazine ban, and other Pittsburgh gun owners are planning legal action of their own.<\/p>\n<p>\u201cI\u2019m certainly disappointed in the vote today, and as soon as the mayor signs [the bills], we\u2019ll be proceeding with the private criminal complaints [against] council members who voted for the measure and the mayor if and when he signs,\u201d said Val Finnell, a physician and gun-rights advocate from McKees Rocks who unsuccessfully attempted to file the criminal complaints in January.<\/p>\n<p>\u201cIt\u2019s illegal. It\u2019s unconstitutional, and you heard Councilwoman Harris say that today. She\u2019s absolutely right, and there\u2019s got to be consequences,&#8221; he added.<\/p>\n<p>Despite the relatively toothless nature of the rifle restrictions, and the fact that Pittsburgh already has a law that prohibits firing a gun within city limits, supporters of the legislation stood up and cheered when the ordinance passed. In a 1996 challenge to Pennsylvania\u2019s preemption law,\u00a0<em><a href=\"https:\/\/law.justia.com\/cases\/pennsylvania\/supreme-court\/1996\/545-pa-279-1.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"pittsburgh-tricky-legal-strategy\" title=\"Pittsburgh Tries Tricky Legal Strategy to Control 'Assault Rifle' Use within City Limits\" target=\"_blank\" rel=\"noopener\">Ortiz v. Pennsylvania<\/a><\/em>, the Supreme Court of Pennsylvania upheld the state\u2019s prohibition on local gun control laws. As they explained,<\/p>\n<blockquote><p>Because the ownership of firearms is constitutionally protected, its regulation is a matter of statewide concern. The constitution does not provide that the right to bear arms shall not be questioned in any part of the commonwealth except Philadelphia and Pittsburgh, where it may be abridged at will, but that it shall not be questioned in any part of the commonwealth.
