(<em>Photo: Governor Mike Parson Facebook<\/em>)<\/p><\/div>\n<p>The Show Me State has made headlines in recent years for its aggressive support of Second Amendment rights, but the legislature is now considering the ultimate protection: nullification. The Missouri legislature has reintroduced a bill that would nullify all federal gun control laws within the state and bars state agencies from employing any federal law enforcement official who tries to enforce said laws.<\/p>\n<p>The Missouri House and Senate passed <a href=\"https:\/\/www.stltoday.com\/news\/local\/stcharles\/missouri-house-passes-federal-gun-law-nullification-bill\/article_17142b9e-d62b-56af-901b-7fe92c61735e.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"missouri-banning-federal-gun-laws\" title=\"Missouri Considers Banning all Federal Gun Control Laws within the State\" target=\"_blank\" rel=\"noopener\">a similar piece of legislation in 2014<\/a>, but then-Democratic Gov. Jeremiah Wilson &#8220;Jay&#8221; Nixon vetoed it. Now that a Republican holds the governor\u2019s mansion in Jefferson City, Missouri may well become the first state to bar enforcement of laws that restrict its citizens&#8217; gun rights.<\/p>\n<p>According to the <a href=\"https:\/\/www.senate.mo.gov\/19info\/pdf-bill\/intro\/SB367.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"missouri-banning-federal-gun-laws\" title=\"Missouri Considers Banning all Federal Gun Control Laws within the State\" target=\"_blank\" rel=\"noopener\">Second Amendment Preservation Act<\/a>, \u201cAll federal acts, laws, executive orders, administrative orders, court orders, rules, and regulations, whether past, present, or future, which infringe on the people\u2019s right to keep and bear arms as guaranteed by the Second Amendment to the United States I and Section of the Missouri Constitution shall be invalid in this state, shall not be recognized by this state, shall be specifically rejected by this state, and shall be considered null and void and of no effect in this state.\u201d<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/missouri-bill-requires-all-residents-to-own-an-ar-15\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"missouri-banning-federal-gun-laws\" title=\"Missouri Considers Banning all Federal Gun Control Laws within the State\" rel=\"bookmark\">Missouri Bill Requires All Residents to Own an AR-15<\/a><\/h2>\n<p>The bill\u2019s authors point out that even though the state governments granted supremacy to the Constitution, respect for the federal government does not require \u201cunlimited submission.\u201d The bill specifies in detail all the types of federal laws and statues that will be null and void within Missouri\u2019s borders and takes thinly veiled shots at NFA tax stamps and firearms registries.<\/p>\n<p>All kinds of federal gun control laws will be void, including<\/p>\n<ul>\n<li>Any tax, levy, fee, or stamp imposed on firearms, firearm accessories, or ammunition not common to all other goods and services which might reasonably be expected to create a chilling effect on the purchase or ownership of those items by law-abiding citizens;<\/li>\n<li>Any registering or tracking of firearms, firearm accessories, or ammunition which might reasonably be expected to create a chilling effect on the purchase or ownership of those items by law-abiding citizens;<\/li>\n<li>Any registering or tracking of the owners of firearms, firearm accessories, or ammunition which might reasonably be expected to create a chilling effect on the purchase or ownership of those items by law-abiding citizens;<\/li>\n<li>Any act forbidding the possession, ownership, or use or transfer of a firearm, firearm accessory, or ammunition by law-abiding citizens; and<\/li>\n<li>Any act ordering the confiscation of firearms, firearm accessories, or ammunition from law-abiding citizens.<\/li>\n<\/ul>\n<p>If passed, Missouri&#8217;s proposal will no doubt be subject to intense legal scrutiny. But David Kopel,\u00a0 Research Director of the\u00a0Independence Institute and Adjunct Professor of Advanced Constitutional Law at Denver University, told GunsAmerica that current precedent allows Missouri to order state and local employees not to enforce federal laws.<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/new-year-new-freedoms-constitutional-carry-takes-effect-missouri\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"missouri-banning-federal-gun-laws\" title=\"Missouri Considers Banning all Federal Gun Control Laws within the State\" rel=\"bookmark\">New Year, New Freedoms: Constitutional Carry Takes Effect in Missouri<\/a><\/h2>\n<p>However, Kopel also pointed out that precedent does not allow state officials to block federal officials from enforcing federal laws.<\/p>\n<p>The bill&#8217;s authors appear to be aware of this prohibition. According to the legislation, federal officials are not barred from enforcing the law, but they cannot serve the state in any capacity.<\/p>\n<p>Any federal law enforcement official working within the state who \u201cenforces or attempts to enforce\u201d gun laws or \u201cgives material aid and support to the efforts of others who enforce or attempt to enforce\u201d will be &#8220;permanently ineligible to serve as a law enforcement officer or to supervise law enforcement officers for the state or any political subdivision of the state.&#8221;<\/p>\n<p>In addition, if a citizen believes he or she has been targeted by a law enforcement officer for violation of federal gun laws, the bill also empowers the citizen to sue that officer in Missouri.<\/p>\n<p>In 2014, the Missouri House passed a different version of the Second Amendment Preservation Act on a 110-41 vote, and the Senate passed it 29-4. Republicans currently control over two-thirds of both the House and Senate, and Republican Gov. Mike Parsons took office last year.
