(<em>Photo: AP\/Jessica Hill, File<\/em>)<\/p><\/div>\n<p>In what could be a major blow to the firearms industry in the United States, the Connecticut Supreme Court ruled today that parents of Sandy Hook massacre victims can move forward with a lawsuit against Bushmaster Firearms International, a subsidiary of Remington.<\/p>\n<p>The court ruled in a <a href=\"https:\/\/www.jud.ct.gov\/external\/supapp\/Cases\/AROcr\/CR331\/331CR865.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-allows-sandy-hook\" title=\"BREAKING: Connecticut Supreme Court Allows Sandy Hook Lawsuit against Remington to Move Forward\" target=\"_blank\" rel=\"noopener\">4-3 decision<\/a> that while Remington cannot be held liable for simply selling its AR-style Bushmaster XM15-E2S rifle, the company\u2019s advertising may have been unlawful under Connecticut\u2019s Unfair Trade Practices Act.<\/p>\n<p>The majority argued that a federal statute that protects firearms manufacturers from frivolous lawsuits includes an exception that allows for a suit to be brought under Connecticut\u2019s trade law.<\/p>\n<p>Referencing this statute [known as the Protection of Lawful Commerce in Arms Act (PLCAA)], the court stated, \u201cCongress did not intend to immunize firearms suppliers who engage in truly unethical and irresponsible marketing practices promoting criminal conduct. It falls to a jury to decide whether the promotional schemes alleged in the present case rise to the level of illegal trade practices and whether fault for the tragedy can be laid at their feet.\u201d<\/p>\n<p>Gun rights groups have strongly criticized the decision.<\/p>\n<p>\u201cThis ruling strains logic, if not common sense,\u201d <a href=\"https:\/\/www.saf.org\/saf-says-ct-gun-lawsuit-like-prosecuting-car-makers-for-crimes-of-car-thieves\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-allows-sandy-hook\" title=\"BREAKING: Connecticut Supreme Court Allows Sandy Hook Lawsuit against Remington to Move Forward\" target=\"_blank\" rel=\"noopener\">said<\/a> Second Amendment Foundation founder and Executive Vice President Alan M. Gottlieb. \u201cThe court dismissed the bulk of the lawsuit\u2019s allegations, but appears to have grasped at this single straw by deciding that the advertising is somehow at fault for what Adam Lanza did that day in December more than six years ago.<\/p>\n<p>\u201cThis is like suing Ford or General Motors because a car they sold was stolen and used to run over a pedestrian all because the car manufacturers advertised that their car had better acceleration and performance than other vehicles,\u201d he added.<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/rahm-emanuels-advice-tap-peoples-emotions\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-allows-sandy-hook\" title=\"BREAKING: Connecticut Supreme Court Allows Sandy Hook Lawsuit against Remington to Move Forward\" rel=\"bookmark\">Rahm Emanuel\u2019s Advice Days After Sandy Hook: \u2018Tap Peoples Emotions\u2019<\/a><\/h2>\n<p>\u201cThe majority\u2019s decision today is at odds with all other state and federal appellate courts that have interpreted the scope of the exception,\u201d the National Shooting Sports Foundation (NSSF) said in a <a href=\"https:\/\/www.nssf.org\/nssf-statement-on-connecticut-supreme-court-ruling-in-soto-v-bushmaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-allows-sandy-hook\" title=\"BREAKING: Connecticut Supreme Court Allows Sandy Hook Lawsuit against Remington to Move Forward\" target=\"_blank\" rel=\"noopener\">statement<\/a>.<\/p>\n<p>The NSSF called the court\u2019s interpretation of the PLCAA\u2019s exception \u201coverly broad\u201d and said it is \u201ccontrary to legislative text, cannons of statutory interpretation and the legislative history of the PLCAA.\u201d<\/p>\n<p>At trial, Sandy Hook families argued that Remington marketed the rifle in an \u201cunethical, oppressive, immoral, and unscrupulous manner by extolling the militaristic and assaultive qualities of the rifle and reinforcing the image of the rifle as a combat weapon that is intended to be used for the purposes of waging war and killing human beings.\u201d<\/p>\n<p>They cited examples of advertisements for the rifle depicting soldiers and using language that described the firearm as \u201cthe ultimate combat weapons system.\u201d<\/p>\n<p>The Sandy Hook murderer, furthermore, was \u201cespecially susceptible to militaristic marketing\u201d due to his aspirations of being in the military, according to the families\u2019 lawyers.<\/p>\n<p>\u201cRemington may never have known Adam Lanza, but they had been courting him for years,\u201d Mr. Koskoff, one of the lawyers representing the families, told the panel of judges during oral arguments in the case in 2017.<\/p>\n<p>Gottlieb called that rationale &#8220;absurd.&#8221;<\/p>\n<p>\u201cDid the advertising even remotely suggest that the Bushmaster is best for murdering people?&#8221; he asked. &#8220;That\u2019s a stretch of credulity worthy of surgical elastic.\u201d<\/p>\n<p>\u201cThere is no evidence the killer was driven by any advertising whatsoever,\u201d he continued. \u201cThis is an affront to the First Amendment as well as the Second. In addition, they argued that the weapons were marketed as tools for home defense and target practice, not for committing criminal acts.<\/p>\n<p>James B.
