(<em>Photo: Facebook<\/em>)<\/p><\/div>\n<p>Brandon Zanotti, the local state&#8217;s attorney in Williamson County, Illinois, says he will not enforce new gun legislation if it becomes law.\u00a0 The pronouncement was made at a town hall meeting in Marion, Illinois this week.<\/p>\n<p>&#8220;If you&#8217;re not a felon and you&#8217;re not using it for criminal purposes we are not going to prosecute you for it,&#8221; Zanotti said.\u00a0 &#8220;I think we need to be careful before we start passing all of these bills that start banning everything without again taking a common sense approach.&#8221;<\/p>\n<p>Zanotti is referring to <a href=\"https:\/\/ilga.gov\/legislation\/billstatus.asp?DocNum=107&amp;GAID=15&amp;GA=101&amp;DocTypeID=SB&amp;LegID=115114&amp;SessionID=108\" target=\"_blank\" class=\"clickTracking\" campaign=\"states-attorney-will-refuse-to-prosecute-ban-on-assault-weapons\" title=\"State's Attorney Will Refuse to Prosecute Ban on 'Assault Weapons'\">Senate Bill 107<\/a>.\u00a0 The Bill, which was introduced in the Illinois Senate on January 23, 2019, is currently assigned to the Judiciary committee.<\/p>\n<p>If the Bill passes, the new law will ban the possession, delivery, sale and purchase of &#8220;assault weapons.&#8221;\u00a0 A first offense violation of the law would be a Class 3 Felony.\u00a0 A <a href=\"https:\/\/www.ilga.gov\/legislation\/ilcs\/fulltext.asp?DocName=073000050K5-4.5-40\" target=\"_blank\" class=\"clickTracking\" campaign=\"states-attorney-will-refuse-to-prosecute-ban-on-assault-weapons\" title=\"State's Attorney Will Refuse to Prosecute Ban on 'Assault Weapons'\">Class 3 Felony<\/a> carries a prison sentence of 2 to 5 years, as well as up to $25,000 in fines.<\/p>\n<p>Zanotti explained that if the law passes he is not looking to make felons out of what he considers &#8220;good southern Illinois people&#8221; who use these weapons to protect themselves, hunt or shoot competitively.<\/p>\n<p>&#8220;I&#8217;m not interested in adding a whole stack to my case load when it comes to just good decent people just trying to continue their hobby or just having them for their own personal protection purposes,&#8221; Zanotti continued.<\/p>\n<p>&#8220;This is not a crime if that gets passed that I am going to prosecute,&#8221; Zanotti said.<\/p>\n<p>Some wonder whether a prosecutor can just choose not to prosecute someone for violating a law that&#8217;s on the books.\u00a0 The answer is: Yes, he can.<\/p>\n<h2>SEE ALSO:<a href=\"https:\/\/www.gunsamerica.com\/harden-up-your-home-with-these-important-tips\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"states-attorney-will-refuse-to-prosecute-ban-on-assault-weapons\" title=\"State's Attorney Will Refuse to Prosecute Ban on 'Assault Weapons'\">\u00a0Harden Up Your Home With These Important Tips<\/a><\/h2>\n<p>There is a State&#8217;s Attorney elected for each county in Illinois.\u00a0 The State&#8217;s Attorney is a <a href=\"https:\/\/www.ilga.gov\/commission\/lrb\/con6.htm\" target=\"_blank\" class=\"clickTracking\" campaign=\"states-attorney-will-refuse-to-prosecute-ban-on-assault-weapons\" title=\"State's Attorney Will Refuse to Prosecute Ban on 'Assault Weapons'\">constitutional officer<\/a> elected by the people and has broad discretion in choosing which cases to prosecute.\u00a0 No person or entity can force the State&#8217;s Attorney to bring charges.\u00a0 The only check on his charging discretion is by the people, who get to choose the State&#8217;s Attorney in their county during an election held every four years.<\/p>\n<p>Zanotti indicated that he has not yet spoken with the State&#8217;s Attorneys in other counties, but he plans on asking them to join him in refusing to prosecute gun owners who are not committing other crimes if the law passes.<\/p>\n<h2 style=\"text-align: center\">***<a href=\"https:\/\/gunsamerica.com\/\" campaign=\"BuySellGA_Register\" target=\"_blank\" class=\"clickTracking\">Buy and Sell on GunsAmerica!<\/a>***<\/h2>\n","protected":false},"excerpt":{"rendered":"<p>Some wonder whether a prosecutor can just choose not to prosecute someone for violating a law that&#8217;s on the books.\u00a0 The answer is: Yes, he can.<\/p>\n","protected":false},"author":107,"featured_media":105761,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[244,7,240],"tags":[132,607,122],"featured":[],"hunt365":[],"class_list":{"0":"post-105757","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-2nd-amendment-r2kba","8":"category-gunsamerica-authors","9":"category-this-week","10":"tag-buzz","11":"tag-news","12":"tag-r2kba"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.1 (Yoast SEO v27.3) -
