(<em>Photo: Facebook<\/em>)<\/p><\/div>\n<p>The South Dakota State Senate passed a bill yesterday on a 23-11 vote that would allow permit-less or \u201cconstitutional\u201d carry of concealed firearms. With a new governor in Pierre, gun owners are hopeful the legislation will finally pass both houses and become law.<\/p>\n<p>Supporters argue that permit requirements only apply to law-abiding citizens, who wouldn\u2019t commit crimes anyway.<\/p>\n<p>\u201cLaw-abiding citizens are currently the only people obtaining permits to carry concealed,\u201d said Sen. Brock Greenfield. \u201cIf you&#8217;re not a law-abiding citizen, you cannot obtain that permit. Allowing these individuals to carry concealed without a permit will not change the fact that they&#8217;re law abiding. Criminals, on the other hand, are already carrying concealed firearms without permits, with no regard for our laws.\u201d<\/p>\n<p>Both residents and visitors to South Dakota would be allowed to carry a concealed handgun without a license, according to the bill (<a href=\"https:\/\/sdlegislature.gov\/Legislative_Session\/Bills\/Bill.aspx?Session=2019\" target=\"_blank\" class=\"clickTracking\" campaign=\"south-dakota-constitutional-carry\" title=\"South Dakota Headed for Constitutional Carry with Senate Win\" target=\"_blank\" rel=\"noopener\">SB47<\/a>). The <a href=\"https:\/\/www.argusleader.com\/story\/news\/politics\/2019\/01\/22\/south-dakota-legislature-constitutional-carry-passes-south-dakota-senate\/2643118002\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"south-dakota-constitutional-carry\" title=\"South Dakota Headed for Constitutional Carry with Senate Win\" target=\"_blank\" rel=\"noopener\">Argus Leader<\/a> reports that some legislators expressed a desire to limit the law\u2019s application to state residents, and the House will have a chance to amend the policy once they begin to consider it.<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/georgia-lawmaker-introduces-constitutional-carry-legislation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"south-dakota-constitutional-carry\" title=\"South Dakota Headed for Constitutional Carry with Senate Win\" rel=\"bookmark\">Georgia Lawmaker Introduces Constitutional Carry Legislation<\/a><\/h2>\n<p>Much of the debate has centered around whether constitutional rights like the right to keep and bear arms can or should be limited.<\/p>\n<p>Opponents of the bill cited the late Justice Antonin Scalia\u2019s observation that Second Amendment rights are not unlimited.<\/p>\n<p>\u201cWe are creating an expectation of extraordinary absolute rights, and that is not healthy for a democracy,\u201d said Sen. Susan Wismer. \u201cI think our democracy would be doing much better if we encouraged our citizens &#8230; to exercise just a bit of restraint and responsibility rather than sell that entitled attitude, the &#8216;we demand our rights&#8217; philosophy.&#8217;\u201d<\/p>\n<p>Sen. Lance Russell disagreed, saying he found Wismer&#8217;s comments to be \u201cdangerous.\u201d<\/p>\n<p>\u201cI think describing people who want to exercise their constitutional rights as having an &#8216;entitlement mentality&#8217; is a very dangerous of way of characterizing the right of people to exercise their constitutional rights, whether it be the First Amendment or the Fourth Amendment,\u201d Russell said.<\/p>\n<h2>SEE ALSO:\u00a0<a href=\"https:\/\/www.gunsamerica.com\/republican-governor-of-oklahoma-vetoes-constitutional-carry\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"south-dakota-constitutional-carry\" title=\"South Dakota Headed for Constitutional Carry with Senate Win\" rel=\"bookmark\">Oklahoma Gov. Mary Fallin Vetoes Constitutional Carry<\/a><\/h2>\n<p>This isn\u2019t the first time constitutional carry has seen success in the South Dakota legislature, but supporters are hopeful it will finally pass the governor\u2019s desk this year. Former South Dakota Gov. Dennis Daugaard vetoed the legislation in 2012 and <a href=\"https:\/\/www.gunsamerica.com\/south-dakota-governor-vetoes-constitutional-carry-bill\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"south-dakota-constitutional-carry\" title=\"South Dakota Headed for Constitutional Carry with Senate Win\">2017<\/a>, but new Republican Governor Kristi Noem <a href=\"https:\/\/www.usnews.com\/news\/best-states\/south-dakota\/articles\/2018-11-23\/constitutional-carry-supporters-await-noem-administration\" target=\"_blank\" class=\"clickTracking\" campaign=\"south-dakota-constitutional-carry\" title=\"South Dakota Headed for Constitutional Carry with Senate Win\" target=\"_blank\" rel=\"noopener\">expressed support<\/a> for constitutional carry during her campaign in 2018.<\/p>\n<p>While she didn\u2019t support any particular language, her campaign said she supported the idea \u201cin principle.\u201d<\/p>\n<p>\u201cThere are a lot of Republicans that are very excited to have a conservative governor,\u201d former South Dakota Representative and current Senator Lynn DiSanto told the Associated Press. \u201cI think under a new
