Why Hunter Biden Shouldn’t Be Convicted…

IraqVeteran888 made the following case on X about Hunter Biden, who is now on trial facing three felony gun charges. 

Per The AP, the president’s son, a confessed drug addict, is accused of:

  • Lying to an FFL
  • Making a false claim on a Form 4473 (checking that he wasn’t a user of illegal drugs)
  • Unlawfully possessing a firearm for 11 days

What are your thoughts?  Do you believe Hunter should be convicted?  Or do you believe IraqVeteran8888 has a point?

    Hunter broke the law multiple times and this is the first time he’s been called to court for it. Sorry Eric, he’s definitely guilty of breaking the law. The argument as to whether that law is constitutional is a fight for another day. Unfortunately, as I’m sure we’ll see, if convicted as he should be, he will either receive no prison time or will be given a token sentence at a white collar “low risk” country club prison where he will quickly be paroled for “good behavior” aka the rich and powerful release program. The same will be the case with Alec Baldwin if he’s convicted.

    Congress is allowed to make laws correct? The President then signs the bills they are in? Then the courts uphold them or toss them? Some of the laws after 1791 don’t contradict the Constitution. We all know that some do and some don’t and then some are upheld under scrutiny that later (or, much later) are thrown out. Are these particular laws in question not constitutional because they were not created using the correct process to become and remain laws? Bruen is a big deal if you read the entire thing. I don’t think anything stands up to it myself. I read it and I think certain laws make sense but to be officially correct the whole system needs to be redone after that decision.

    Think of all the people you know who smoke pot/use cannabis products and check the same box on the 4473 that Biden did. We’re talking MILLIONS of decent people. Should they be subject to this as well? Even if pot is legal in the state they purchase the firearm in, it’s still illegal at the federal level. Personally, I don’t like pot, but it kills far fewer people per year than alcohol. This case is like Iraq vet said. It’s smoke and mirrors to help avoid bringing light to much larger crimes. Better he does a bit of time for the 4473 gig than the life sentences him and his father would receive if there was a serious investigation on his past foreign employment opportunities. Again…smoke and mirrors.

    Personally, I think Hunter AND his dad are a waste of good human flesh. It’s definitely arguable as to whether or not mentioning drugs on the 4473 form violates our constitutional rights, but the fact of the matter is the way the law is written currently, he absolutely violated the law and should be punished. Sadly, at the very most he will get a slap on the wrist and an ass-chewing by his liberal soft-on-crime judge – or nothing at all.

    IRAQVETERAN888 has a valid point about the laws from 1791 but we’re not living in 1791. Times change and so do the people, unfortunately we need certain protections for the general population, like felons can’t own or possess firearms. Don’t take this the wrong way either. I do not believe in big government, but unfortunately, it’s what we have and for the most part our laws are actually meant to protect the people. As far as the larger issues with son of the POTUS, good luck getting him charged for any crimes. This is were my faith in our justice system fails me. I think I would take whatever win I could get at this point.

    I agree with Iraqveteran8888. All gun laws are unconstitutional. We should have to get permission from the government to own firearms. Even convicted felons who served their time should be able to own firearms and vote.

    To lie on a 4473 is too perjury ones self. Hunter lied. To use illegal narcotics is a federal crime and sometimes a state and local crime. Hunter admitted in a book to using several types of illegal narcotics in the same time period as purchasing a firearm. Marijuana is still a federal crime but no longer a state crime. To lie to a federal agent or lie on a federal form is a federal crime, General Flynn was set up on such a false federal crime crime charge of lying to a federal agent. The criminals in the Barry Soetoro Administration were the real criminal liars. So I guess the question is, does Heller and Bruen negate a federal charge of perjury for Hunter?

      The use of illegal drugs is not a federal crime. It’s a state crime. Trafficking across state lines is a federal crime.the possession and use of marijuana is a federal crime still but legal in some states. But lying on the 4473 form, which I consider unconstitutional, is a crime. And it’s not going away and other people have been convicted of lying.Hell ATF is visiting people who buy two guns at the same time which is allowed. If they don’t like it, take the second gun part off the damn form. I’d like to go down to Macys in downtown NYC and buy a couple potato diggers like they did during the Spanish American war when some parents went and bought two for their son in the aRough Riders Wonder if atf visited them because they bought two?

    I agree the law should be changed, but until it is, it should be equal treatment under the law. Hunter and Joe have already been protected from the consequences of their corruption by the Democrats in Congress and the JD. In the case of the gun charges, I would go to prison if I did what he did, and so should he.

    All Points valid BUT this case is not about the constitutionality if these points, this is about the LAWS WE HAVE IN PLACE NOW, the laws EVERY other gun owner has to follow by force of LAW! Scumbag biden needs to feel the pain anyone of us would if we were charged. ATF just killed a man over bullshit, selling personal property and no ones cares! Argue the 4473 to the SCOTUS and have it thrown out or validated, same with illicit drugs and every other law we don’t agree with, maybe start with the NFA?? Till then Hunter can dry out in prison!

    The law that is in place will need to go through the courts to be nullified based on Bruen. However, it is currently in place and Hunter violated that law. Any regular citizen would be imprisoned already. He did it. He knowingly lied and knew he was breaking the law. The actual drug use when he purchased is a separate charge. There is still the charge of lying on the federal form. The question is, if it is found to be unconstitutional under the Bruen ruling, will others who were convicted be set free? If it is unconstitutional now, it has always been unconstitutional.

    Excellent point. There are much bigger issues here than spanking the smartest man our president knows.
    First and foremost we want the Bruen decision to be employed as per the Supreme Court and not bastardized as some lower courts have done. Thats way more significant than seeking retribution for Hunter. Regardless I think by now we should be able to recognize a show trial as we’ve be exposed to them since Jan 6th.
    More Judicial theatre.

    There was also no law in 1791 preventing a scizophrenic from buying a gun. That doesn’t mean any current law that does prevent it is somehow unconstitutional. As someone once said, the Constitution is not a suicide pact. It is absurd to suggest that gun ownership by drug addicts and scizophrenics is protected by the 2nd Amendment, just as it would be absurd to suggest that defamation is protected by the First Amendment. The word “people” whose rights are protected by the Bill of Rights does not refer to absolutely everyone regardless of age, condition, circumstance, country of residence, citizenship, state of disease or criminality, etc.

    If HB were to be aquitted and the form 4473 and all other such federal regulations ruled unconstitutional I would consider it a fair trade. However, anything short is nonsense. If you or I did it we’re going to be prosecuted.

    His defense is barking up the wrong tree anyway IMHO. The best defense theory is, ironically, a 5th amendment one not a second amendment one.

    You’re right; I don’t like what you say, but you’re entitled to your opinion. Simply said, there are certain types of individuals with certain kinds of behaviors that should not qualify to own firearms. One specific type in particular comes to mind–anyone like Hunter Biden. Liars, thieves, substance abusers, and the mentally ill should not be allowed to own firearms. Dangerous individuals should not have access to weapons; people who, by their very nature, are a threat to law-abiding citizens. Convicted felons are currently included, and rightfully so. Give them time. They’re not finished with Hunter. He will be a convicted felon in the not-to-distant future.

    If Hunter Biden is found not guilty then all citizens found guilty of lying on the gun buying form should be freed from prison, have those records removed from their files and be recompensed for the time they wre incarcerated. We all know that papa Joe will pardon and release Hunter if he is convicted.

      Iraqi Vet has alot of videos and he is on the side of the 2A. He does NOT support Biden at all. What he is saying is that under the Bruen and Heller cases, the charges against Hunter are not based on the test of text and history going back to the time of 1791. Will the Heller and Bruen secure a not guilty verdict for Hunter? Probably NOT but the fix is in one way or another or the defense would have cut a deal by now. The PICA (Protect Illinois Communties Act) also defy Heller and Bruen and the USSC are slow to hear any cases despite the clear violations of those two case histories.

      Just like you point out, the un-Constitutional case against Trump made it through state courts even though there was no case. Now, Hunter can be found guilty despite legal precedent under Heller and Bruen . The jury will probably go easy on Hunter and the “no one is above the law” BS will be tossed around for a couple more news cycles.

    I’m not a lawyer and so I guess that the Heller case seems to be the first case of text and history while Bruen reaffirmend the earlier decision.

    I would wait to hear the historical and legal arguments before I cast my formed my final opinion but yes, all federal gun laws seem to fail the 1791 test according to the Bruen decision. At the same time, IRS is un-Consititutional but I still file my taxes (for now).
