Due process. Blah! Who needs that, right?
Tell ya what. Government needs to just start confiscating guns today from anyone and everyone anyone deems is a threat. We can sort out the whole thing at a later date. Ya know, down the road when we get around to it. A week. A month. At some point.
My idea? Nope. President Trump basically suggested this Wednesday during his gun control powwow at the White House.
While vice president Mike Pence was explaining the details of a gun control measure — known as an extreme risk protection order — that allows law enforcement and family members to petition courts to seize guns from individuals they believe to be troubled, Trump cut in to say that authorities shouldn’t wait on a judge. They should just go in and grab the guns.
“Or, Mike, take the firearms first and then go to court,” Trump said. “Because that’s another system. A lot of times by the time you go to court, it takes so long to go to court, to get the due process. I like taking the guns early. Like in this crazy man’s case that just took place in Florida. He had a lot of firearms. They saw everything. To go to court would have taken a long time. You could do exactly what you’re saying but take the guns first, go through due process second.”
Yikes!
Well, I guess there are two ways to look at this. Either Trump is just spitballing on the fly, with no real sense of what he’s actually suggesting: extraconstitutional gun confiscation! And this will all be cleared up later by his handlers at 1600 Pennsylvania Ave.
Or, the man really believes what he says. Government should start roundin’ up guns. Because due process is for the birds.
Let us hope he was just talkin’ out his behind and that he wasn’t really saying what he was, in fact, saying.
If due process is gone, then this country is done. All that matters will just fade away, as the old guard just did not do enough to educate the young! I never thought the Left would win!
Due process would have taken care of this case before it started if it wasn’t for the Obama era diversion program that kept Cruz out of the court system that would have resulted in him failing background check. If you want to keep the public safe you have to have a lot better policy than see no evil, hear no evil, speak no evil.
To everyone who said Trump would never enact gun control measures and that “he is not like Hitler”… yea… sure thing. He banned the importation of the Vepr like 2 months into office… and everyone gave him a pass, while telling me I was over reacting to the import ban. I will have no sympathy for *anyone* who supports or stands behind this dictator-waiting-to-happen. You either stand with the American *people* or you don’t, I don’t care which political party you are from, if you stand with any of them at this point you do not stand for our freedom and liberty.

If Trump were to make a serious dent in the number of “assault” weapons and their accessories available to the public, his popularity with the left, a group that loathes him, would take a big jump. He is sometimes described as a ‘closet Democrat’ and he craves love.
I don’t know why people would find this startling, as Ajit Pai already told you that you have lost control of your government. Border Patrol can violate your 4th Amendment rights if you are within 100 miles of any border. Do you really believe that they are not going to add another zero to that number soon?
Wow. His Orangeness may be less gun-friendly than Hillary. How about that “most pro-2A President ever” thing now, huh? But her e-mails, though! Maybe Trump is thinking about switching parties again? The credible mainstream media would stop talking about all of his sex scandals overnight.

So called “Due Process” isn’t possible if the suspected is sentenced BEFORE going to court. That’s the whole point of the Fourth Amendment – the accused gets an opportunity to face his/her accuser and defend his/her rights before being judged, let alone sentenced.
Reel in the emotions and bravado so common sense can prevail.

“Extreme Risk” TROs do not violate due process, since the orders are of short duration and must be followed by a full blown trial court hearing with notice and an opportunity to be heard. This has been well-established through constitutional challenges to domestic violence temporary restraining orders.
That said, our President is massively overcompensating over the latest shooting. The fact of the matter is that even had such a law been on the books, the police, the school, and social services dropped the ball on Mr. Cruz. To make matters much worse, he has told two senators that national reciprocity should not be coupled with the FixNICS bill, “because we have to do something.” But without connecting the two, as does the House bill, leverage is lost and the odds of overcoming a Democratic Party filibuster on the reciprocity bill is slim to none. I am reasonably certain that there will be no national reciprocity law passed this year, and if the midterms go as currently projected, with Democrats picking up a few key seats, reciprocity is dead.
I thought we might actually get some pro-gun legislation passed this session, like the HPA. The NRA, Republicucks and Trump are a joke and have sold us down the river. I’m done with all three!
