In a bold move challenging Hawaii’s restrictive gun law, the Second Amendment Foundation (SAF) has filed a supportive amicus brief for a temporary restraining order and preliminary injunction.

The move is part of a case known as Wolford v. Lopez, filed in the U.S. District Court for the District of Hawaii.

According to the brief, Hawaii’s recent actions echo those of New York, New Jersey, and Maryland, which undermined the Supreme Court’s pivotal Bruen ruling.

This ruling upholds the right to carry self-defense mechanisms, aka arms.

However, Hawaii’s SB 1230 law, passed after the Bruen ruling, severely restricts these rights, specifically targeting law-abiding citizens who take these rights seriously.

Dubbed the “Bruen response bill,” SB 1230 significantly limits where licensed citizens can carry firearms for personal protection.

The legislation has been criticized for its restrictive nature and has sparked fear amongst citizens wishing to exercise their constitutional rights.

SAF founder and Executive Vice President Alan M. Gottlieb strongly criticized Hawaii’s new law.

“Hawaii’s new law is written to make citizens afraid to exercise their constitutional right to bear arms, to the point they’re even afraid to enter a coffee shop without first being invited,” explained Gottlieb.

“We cannot have law-abiding citizens afraid to exercise a right for fear of being prosecuted and made into criminals,” he continued. “That is not how the constitution works, and specifically, it is why the Second Amendment includes the phrase ‘shall not be infringed.’ SB 1230 constitutes a serious infringement.”

“There are no historical analogs supporting the extreme nature of Hawaii’s gun law,” added SAF Executive Director Adam Kraut.

“To the contrary, as we explain to the court, history shows lawmakers respected Second Amendment rights as part of everyday life, to the point of encouraging people to bring their guns to public meetings and even church. Hawaii, on the other hand, is trying to make have a gun outside of one’s home or private vehicle a crime.”

SAF is a leading gun rights organization, focusing on upholding the constitutional right to privately own and possess firearms.

Its actions are seen as a steadfast defense of American citizens’ Second Amendment rights against legislation like Hawaii’s SB 1230.
