Writing for the majority, Senior U.S. Circuit Judge Alice Batchelder argued that the ATF did not have the authority to criminalize millions of bump stock owners and that the agency’s application of the federal machine gun statute is improper.

A bump stock case in Houston is making waves in the pro-gun community after federal prosecutors dropped bump stock-related charges against a man because “the government couldn’t prove beyond a reasonable doubt the bump stock was a machine gun,” according to the Houston Chronicle.

The U.S. Court of Appeals for the Tenth Circuit gave bump stocks new life last week when they ruled to vacate a previous decision that upheld a ban on the devices.

“Before deciding whether to weigh in, we would benefit from hearing their considered judgments — provided, of course, that they are not afflicted with the same problems. But waiting should not be mistaken for lack of concern,” Gorsuch concluded.

“The law is different in this case because the government, as the sovereign, has the power to take property that is dangerous, diseased, or used in criminal activities without compensation,” Smith wrote in a nine-page ruling.

What Cuomo did, then, is ban an innocuous piece of plastic that was already prohibited under federal law because like so many other politicians he knows virtually nothing about firearms nor the existing laws regulating them.

“I fought for these rights,” Grisham, a retired Army 1SG, continued “I fought for the rights to keep and bear arms. If I’m going to fight overseas for those liberties, I’m sure as heck not going to give up and home and not fight for them.”

Bump stock owners have appealed last week’s ruling by a federal court that allowed the Bureau of Alcohol, Tobacco, and Firearms’ new bump stock ban to move forward as scheduled.

“Just because we’re signing this today doesn’t mean there isn’t more to do,” Pritzker said at the signing ceremony held at an elementary school in Chicago.  “But this particular bill is very important.”
