NRA Triumphs in Texas Court over Pistol Brace Rule

GOP Lawmakers Introduce Bill to Deregulate Certain NFA Firearms, Stop Pistol Brace Registration

The National Rifle Association (NRA) announced a critical legal victory this week.

A Texas court blocked the enforcement of the controversial “pistol brace rule” against NRA members, marking a big win for 2A advocates.

The NRA launched this legal battle in the Northern District of Texas last July. The lawsuit targeted the ATF, U.S. Department of Justice, and ATF Director Steven M. Dettelbach.

The NRA contested the ATF’s rule that sought to reclassify pistols with braces as rifles, imposing stringent NFA regulations and taxes.

Court’s Groundbreaking Ruling

On March 29, U.S. District Judge Sam A. Lindsay recognized the NRA’s standing to represent its members’ gun rights.

He echoed the Fifth Circuit’s findings that the ATF bypassed essential procedures in enacting the “pistol brace rule.” The judge highlighted the agency’s disregard for extensive negative feedback from NRA members.

NRA President Hails Victory

NRA President Charles Cotton celebrated the ruling, deeming it a major triumph for Second Amendment freedoms.

“This is a major victory for the NRA, its members, and all who believe in Second Amendment freedom,” said President Cotton in a press release obtained by GunsAmerica.

“From day one, we vowed to fight back against President Biden and his rogue regulators – and to defeat this unlawful measure,” he added.

Protection for Gun Owners

This legal win safeguards millions of NRA members, including those with disabilities, who rely on pistol braces for safe firearm use.

The ATF’s rule reversal would have criminalized the use of these braces, leading to severe penalties for lawful owners.

NRA’s Pivotal Role and Injunction

NRA counsel William A. Brewer III lauded the association’s key role in opposing the ATF’s rule.

“The NRA has emerged as a leading voice in opposition to this unlawful attempt to limit Second Amendment freedom,” said Brewer.

“When it was determined NRA members could not benefit from other injunctions, the Association moved to the tip of the spear in the advocacy and prevailed in obtaining sweeping relief for its members,” he added.

The NRA represents a vast network of members nationwide, including a significant presence in Texas (350,000 members), the leading state for NRA membership.

    Even if the NRA died a slow death under LaPierre, we should still rejoice every single time the ATF is made a laughing stock. Disbanding those bastards would be my very first priority in “Frank’s World”!

      It did, and has done so before. But the NRA is much stronger than just one person or a small cabal of miscreants lead by LaPeierre. They’ll be back.

    Be aware, that this has to do with adding the NRA to the list of those it already applies to. GOA and SAF were already covered under this by their independent lawsuits, and what seems like an odd interpretation, actually only applies to members of groups like GOA, SAF, and now the NRA, and not the country at large. So, more to come when the final decision is made.
