New ITAR Guidelines Look a Lot Like Executive Gun Control

The Department of State is issuing new guidelines requiring many machine shops and gunsmiths nationwide to register with ITAR. The cost? $2,250 per year. ITAR, or International Traffic in Arms Regulations, are designed to prevent firearms and firearm technology from being exported out of the country.

But the actual reason behind this sweeping change in guidelines may have a darker goal: to increase the cost of offering gunsmithing services. The changes were implemented without warning or input from the people and the industry.

ITAR requires that “Anybody who engages in the business of ‘manufacturing’ a defense article to register with DDTC and pay a registration fee that for new applicants is currently $2,250 per year,” explains the NRA. “These requirements apply, even if the business does not, and does not intend to, export any defense article. Moreover, under ITAR, ‘only one occasion of manufacturing … a defense article’ is necessary for a commercial entity to be considered ‘engaged in the business’ and therefore subject to the regime’s requirements.”

The changes to the rules now include just about anything other than installing drop-in parts as “manufacturing.” This means that any service that requires cutting, fitting or ‘special tools’ is considering manufacturing. If these companies wish to continue offering these services they will need to pay an additional $2,250 per year in fees.

In response to questions from persons engaged in the business of gunsmithing, DDTC has found in specific cases that ITAR registration is required because  the  following  activities  meet  the  ordinary,  contemporary,  common meaning of “manufacturing” and, therefore, constitute “manufacturing” for ITAR purposes:
a) Use of any special tooling or equipment upgrading in order to improve the capability of assembled or repaired firearms;
b) Modifications to a firearm that change round capacity;
c) The  production  of  firearm  parts  (including,  but  not  limited  to,  barrels,  stocks, cylinders, breech mechanisms, triggers, silencers, or suppressors);
d) The  systemized  production  of  ammunition,  including  the  automated  loading  or reloading of ammunition;
e) The  machining  or  cutting  of  firearms,  e.g.,  threading  of  muzzles  or  muzzle  brake installation requiring machining, that results in an enhanced capability;
f) Rechambering firearms through machining, cutting, or drilling;
g) Chambering, cutting, or threading barrel blanks; and
h) Blueprinting firearms by machining the barrel.

Thus installing a same-caliber replacement barrel on an AR rifle would not be considered manufacturing, but reaming a .223 Remington chamber to .223 Wylde would be. Similarly, installing an aftermarket trigger in a rifle is not manufacturing, but tuning an existing trigger is.

Even then the guidelines are vague, limiting “gunsmithing” to only work that doesn’t “improve the accuracy, caliber, or other aspects of firearm operation beyond its original capabilities,” leaving a lot up for interpretation.

This is likely to have a significant impact on smaller business who offer these services who can’t or don’t want to squeeze the extra cost out of their budgets. It will also affect the general consumer as shops that do will have to raise the prices of their work.

That’s exactly the point of the new regulations, says the NRA. “DDTC’s move appears aimed at expanding the regulatory sweep of the AECA (Arms Export Control Act) [and] ITAR and culling many smaller commercial gunsmithing operations that do not have the means to pay the annual registration fee or the sophistication to negotiate DDTC’s confusing maze of bureaucracy.”

And shops that offer these services are going to really want to make sure their paperwork is in order, since the punishment for violating ITAR is steep.

“Additionally, the penalties for violating ITAR are significant and able to be applied retroactively,” writes Prince Law’s Adam Kraut. “Penalties for each violation of ITAR can result in up to $1,000,000 in fines and 20 years imprisonment.”

It’s not clear if these businesses will have to retroactively pay for ITAR registration if they are already engaged in “manufacturing” firearms. If so, the cost of registration could be even higher. And it could take some time for these businesses to comply with the new regulation, putting them at real legal risk between now and then.

The Directorate of Defense Trade Controls or DDTC, which drafted the new regulations, has a response team set up to help businesses navigate ITAR waters. For information on how to contact the DDTC and to see the regulations in full, check out the guidelines letter (.pdf).

Better still, potentially ITAR-regulated businesses should have an attorney contact the DDTC for them.

    As I sit and read all of your comments it scares me that as gun owners we cannot be more united. These kind of tactics that the so-called law-makers and political hacks have been using for over 80 years. Little by little they have eroded our rights and gun ownership. There are over 100 million gun owners in the USA. WHY are there only 5 million of us willing to spend $35 a year to belong to the only pro-gun power force we have in the NRA. I hear these stupid hunters say ” there not talking about taking away my hunting rifle” why should give them my money.” How stupid can anyone be? All you have to do it to look at history and see how they did it in Great Britain and Australia. They started with banning certain guns and it lead to registration and confiscation of all guns. Are gun owners that stupid? We must stop any law that starts down the slippery slope of banning anything associated with firearms. Support politicians that are pro gun and groups that have the best pro-gun attorneys on their payroll. Can you imagine the power 100 million gun owners voting for someone who is on our side. That is more voters than the total that voted in the last presidential election in total. We have 1 choice here you must vote for TRUMP. I know he is not ideal but he IS the only choice here. Tell everyone you know to get out and vote this year, or we will be Fucked in 4 months.

    This obviously is an attempt to put gunsmiths out of business. The laws involved with ITAR are very complicated, in most cases vague, with very (VERY) serious penalties if one decides to ignore them. Not only is there a fee that is a major expense for any small business, to understand and keep up with the laws involved one practically needs a lawyer on staff to interpret, and to handle all the paperwork.

Many genius’s that are actually the ones that are constantly improving our arms. Would the current M-4 be what it is today if gunsmiths didn’t see promise in the shaky start of the m-16? Imagine how European this country would be if our colonial predecessors had sat back, as if spectators of a sporting event, while King George chiseled away at their freedoms.

      Americans have a duty to resist. Non-compliance, and other acts of civil disobedience are in order, not just spectator ship. As it stands, voting, by itself is not going to change anything; not when the system has been rigged, to allow participation by folks with conflicting interests.

This new law, is in itself racist because these high fees prevent mostly minority business owners from being able to have a legal affordable gunsmithing shop. My point being is that many minority groups are in an extremely lower income bracket, and thus cannot afford these bigoted fees . But a rich White person can . Just thought I’d mention it. This is a generalization of a wide spectrum of Americans high & low income .

      All gun laws have been created to prevent the poor, or in reality the black man, from obtaining guns or making any modifications to them. Look back in history and you’ll find one of the very first gun law was put in place just after the civil war, right after salves were freed. The $200 tax for certain firearms items was created to prevent the lower class and yes, the black man, from obtaining such arms. I am white, I am Republican, and Conservative. I am a lifetime NRA member, a GOA member, as well as others and I spend a lot of time writing congressmen about our gun laws. These things effect us all and even though I could afford the cost of the tax and increase in tooling, I would rather not. This will force many to do for themselves and possibly getting it wrong putting themselves and other around them in danger from a poorly done mod.

      This rule (not law because it was not passed by Congress) is also discriminatory against the elderly. I am a retired gunsmith who keeps his hand in as a hobby. Under these rules, my pension does not provide enough for me to register. It is also discriminatory against the small gun shop owner, requiring them to forego any gunsmith work due to the expense.

      But, with this rogue administration I guess that is the intention.

    I pointed this out to my gunsmith last week and he got together with another gunsmith who has an attorney on retainer.
    He (attorney) pointed out that the term “retroactive” allows for a date sometime during 2012. I would have thought it would have meant since this announcement. No.
    That could equate to right close to $10,000 of taxation without representation just to bring the tyranny up to date.
    My gunsmith just showed me a mailing that he and his G.S. buddy received yesterday from the Department of Justice “inviting” him to attend a “free” information seminar next week, with no explanation as to what the topic is .

    Thanks for blowing the whistle on this farce. The Obama administration can’t claim now they’re not going after sportsmen – almost every gunsmithing operation requiring ITAR registration is one that is common for hunting and target firearms. Very few of these would be required for firearms exported to nations which lacked the requisite skills to perform those jobs in-country. It’s cynical legislation by expanding regulation beyond the Congressional intent of the laws concerned. And that is impeachable.

As well, an individual who does any of these machining processes is NOT A BUSINESS and is not required to pay this fee just as they don’t have to have an FFL. Hillary Clinton has already stated that she wants gun manufacturers to be held liable for injuries or death caused in the use of a firearm, even if the firearm itself is NOT defective. Imagine what that would do to the industry! Now, you might say, well they’d have to hold auto manufacturers responsible for any and all injuries and deaths caused by a car, even if the car was operating normally. Expand that to hammers, baseball bats, knives, etc. For now it would never stand a SCOTUS review, BUT once Hillary packs the court with liberals, just watch how they rule in favor of holding gun manufacturers liable.     State Dept has been doing their part to kill the firearms industry since the late 1990s – i used to export and was registered. Fees went from $250 / yr ($200/yr if paid 5 yrs at a time) to $2250 and you had to pay two years at a time. If that wasn’t bad enough, applications to export took anywhere from 6 – 12 months to be reviewed, and usually were denied. There six licensing officers, and in a newsletter their Biographies were detailed – they were all young attorneys 2-3 years out of George Mason or Georgetown Law school. The application to export took 3-4 hours to prepare (i kid not) and were turned down 50% of the time. But when they denied an export license on 5,000 M1 leather slings and i then discovered leather goods were considered obsolete technology and therefore exempt from requirement for export license, that was when i decided to terminate my export registration. It took me 1.5 years to terminate it, with letters threatening me with horrendous fines unless i paid the fee, EVEN THOUGH I HAD TERMINATED ALL EXPORT ACTIVITY. I finally terminated my ATF 08 importer’s license to terminate the State Dept exposure. If you read ITAR carefully, Johnson & Johnson should register with state dept as they manufacture Q-Tips, which can be and are used to clean firearms.
    We are rapidly approaching the bottom of that slippery slope, and if hillary is elected, we’ll hit it with a thud

    I want to know why I see no efforts to stand up to this by the NRA, GOA or any of the other pro gun organizations. I keep getting emails with money requests but nothing with requests to contact my representatives on this matter. Seems very odd to me. Especially the GOA not climbing all over this. Also are the big manufactures going to sit by and watch this put the small gun smith shops out of operation or are they going to step up and offer support to stop this? I surely hope there hasn’t been some backroom deals made by the NRA and others in the gun industry.

    As to Execute Orders. In accordance with the Constitution if anyone challenges an executive order within 30 days it must be voted on by Congress in order to become law.One might want to keep that in mind before getting to riled up. Start studying the Constitution and get to know it from the beginning through the 19th Amendment.

      There is no mention of executive orders in the Constitution at all, much less some 30 day challenge period. Congress could certainly try and pass a law to override the EO, in any time frame, but the President has veto power so that would be a tough one to do.

    $2,250.00 per year? The stated intent of this new regulation could be realized with a $5.00 fee per year. As the author of this article said, this regulation is a naked mandate to price gunsmiths out of business.

    If obama’s goon bureaucrats can spring this abomination on the people who service privately owned firearms, they can increase the yearly fee to $5,000.00 next year and then keep doubling the fee every year thereafter until the description “gunsmith” will be a quaint archaic word from the past. You know, the past before obama.

    EACH violation is punishable with fines up to $1,000,000.00 and/or 20 years in prison! This is the real infringement against the Second Amendment. How many gunsmiths will risk such retribution for tuning up a trigger? Any stranger that walks through the door with a request to do illegal work on his firearm could be a Federal agent looking to add notches on his gun to earn a promotion.

    Find a liberal who voted for obama and give him a special thanks for putting a tyrant in the White House. Oh, the Hildabeast would be even worse than obama. She wants to outlaw the Second Amendment, and her new Supreme Court nominations will back her up on such a move.

    ITAR is a UN regulation of a foreign power. As declared declared by the Supreme Court the UN is a foreign power and under the Constitution has no authority in the US. In addition only Congress has the authority to create new laws.
    My advice to manufacturers & gunsmithsis not to deport anything out of state. When the federal government attempts to exert authority be ready for a courtroom battle. Congress has no authority under the Constitution to interfere with intrastate commerce. They only have authority under the Constitutionto regulate interstate commerce.

    I don’t see what the big deal is about this – other than the expensive registration fee. (But government fees go up every year for all kinds of different regs). Ive worked with ITAR regs for years and this is nothing out of the ordinary. ITAR’s purpose is to prevent our awesome US weapon technology from falling into the hands of our enemies – for obvious reasons. Personally I like the idea of preventing our enemies from using the incredible gun tech we have from being used against us. The reason the definition of “machining” or smithing is so broad is because the alternative is to have the ATF hiring a million agents to go around crawling up the a$! of every single gunsmith and/ or manufacturer to make sure the technology is protected. So rather than grow the monitoring agency any bigger the alternative is to require the registration. Think how many various gun manufacturers have popped up over the last few years – just AR manufacturers- too many to count. I prefer that ATF/ homeland security agencies not get any bigger.

      Foreign technology in this sector is superior. Many of the machines used by US gun firs is foreign made.

      Gee, if we want to stop the export of our firearm technology, maybe we should stop giving weapons to anyone in the Middle East who asks. Just take a look at what ISIS fights with – 100% good ol’ ‘American made hardware provided by our brilliant politicians to the Iraqi Army who then graciously turned them over to ISIS.     This is just our President using his over reach of Executive Orders to implement a form of gun control. Without the one man gunsmith shops in small towns, lots of older guns that break and become unusable will remain so. That, and that alone, is the sole purpose of this “regulation.” No thought given to the impact made on the people who rely on these shops – the owner / operator is not doing it for his or her health but for the income it provides. The people that bring older guns in for repairs might rely on that gun to eat. Our government, our President, is out of control and writing law without legislative process. There is a phrase he and the rest of the Executive Branch need to recall, “Taxation without representation.” Look what that lead to.

Even if a business does not export, they have to pay anyway, is just insane and totalitarian. 20 years in prison if a guys has a metal lathe and reams a barrel violates the 8th Amendment.     A treatise into the history of ITAR, who, what, where and when would be helpful to all of us. Who is leading the fight to remove domestic gunsmiths from these opressive regulations? Look thru a gun parts catalog and you will find parts listed as ITAR that defy common sense. Based on history, its clear that regulation of all hobbyst firearms repairs modification, or construction will be soon on our doorstep. I cant help but think that the UN has something to do these regulations, and Congress has chosen to allow the executice branch to do as it pleases with ITAR.

    Once again, obama has exceded his presidential authority with a EO. If Congress does not take action against the EO, it will stand with the force of Law. The PDF file at the Link clearly defines EOs application, limits of presidential powers, conflicts with existing Law, and how EOs aare evaluated by the Courts to determine if they are within the authority of presidential powers. There is major conflict between this EO/ITAR tnd the existing Laws enforced by BATFE regarding gunsmithing vs manufacturing that ARE current Law. Hence, the Presidend has exceeded his authority by making law and extending its applicability with impact on commerce/industry AND individuals. This Ladies and Gentlemen, is not a Power of the executive branch and is reserved Strictly for Congress and the States per the Constitution.

      Umm, nice try, but no see-gar. ATF regulations under laws pertaining to ATF are one thing, but ITAR falls under the authority of the Department of State, and its power is defined under the statutes establishing ITAR, not those pertaining to the ATF. It does not matter if the definitions of manufacturing in one conflict with those for the other; they regulate different things. Now I agree that ITAR has become WAAAY to expansive, but that is a legislative issue for Congress to deal with. (There was a recent case filed by Defense Distributed pertaining to the interpretation of ITAR regs as pertaining to discussions on blogs. State claimed that these discussions were subject to ITAR because the internet is everywhere. I am pretty sure that DD won the first round.)

        (obviously) the definition of ‘manufacturing’ matters.

        The unstated angle, even in the NRA article, is that the fee is a tax–who can levy taxes?
