California Passes Another Stupid Gun Law

Starting July 1, 2021, California residents will be prohibited from buying more than one semiautomatic rifle per month.  And, starting Jan. 1, 2020, California residents under the age of 21 will be banned from purchasing a semiautomatic rifle.

Both measures are part of Senate Bill 61, which was signed into law by Gov. Gavin Newsom back in October as part of a larger legislative effort to restrict 2A rights in the Golden State. 

“Gun violence is an epidemic in this country, one that’s been enflamed by the inaction of politicians in Washington,” said Gov. Newsom in a statement. “While Washington has refused to act on even the most basic gun safety reforms, California is once again leading the nation in passing meaningful gun safety reforms.”

Prior to the passage of SB 61, residents under 21 could purchase a rifle if they had a valid hunting license.  But state Sen. Anthony Portantino (D-La Cañada Flintridge), the sponsor of SB61, believed it was time to put a stop to that following a shooting at the Chabad of Poway synagogue in Poway, CA, on April 27, 2019.

“These particular violent weapons are not needed for hunting and have become increasingly the gun of choice for mass shootings,” Portantino told SacBee. “We felt very strongly that the hunter’s exemption needed to be removed for this weapon.”

The 19-year-old killer, who did not have a valid hunting license, still managed to purchase a firearm from a San Diego gun store. Portantino believes that although a myriad of existing laws failed to prevent the attack, one more might do the trick next time around. 

“Though that shooter did not have a valid hunting license at the time of his gun purchase, that horrible situation highlighted the need for immediate action,” Portantino explained.

Gun-rights advocates disagree. Alan Gottlieb, the founder of the Second Amendment Foundation, told GunsAmerica in an email that this new law is “stupid.”

“Another stupid anti-gun law. How many criminals use more than one semi-auto rifle when they commit a crime? Like zero,” said Gottlieb.

“This is just to demonize firearms and attack constitutional rights and will have no impact on keeping anyone safe,” he added.

    These anti gun politicians also fail to admit even though their own government agencies tell them gun control will not work that there are more deaths as a result of ,knives -blunt instruments( bats or clubs ) or fists and or kicking. There is no way to compare the deaths as a result of drunk drivers or drug overdoses or for medical mistakes. Look at the number of people that die each year from the flu. Yes the flu. Start putting all this wasted money on mental health instead of the hair brain laws. Stop the college professors from spouting their political brainwashing agendas to their students. If they will not quit the brainwashing then get rid of them. Also the firearm that is most used illegally is not a rifle but a pistol .

    the real problem is that it is easier to pass a new law than it is to enforce any of the dozen laws that are there already. If a person breaks any law pertaining to firearms there should be MANDATORY penalties. The criminal does the time OR the judge ! We all know that people get a free pass or reduced sentence because jails are to crowded etc. but that is the problem ..Soft enforcement..

    Interesting. In 2017, there were 39,773 deaths by gun in the U.S. Only 4% (581), involved a rifle. Good to see CA is, again, leading the nation in meaningless laws which impress their supporters.

    To some folks who do not live in California or travel to California these numerous California Gun and ammunition laws seem like a comedy, “oh look what those liberals out in California are doing now”, but let me tell you these new California laws as related to guns and to ammunition are a real nightmare.
    We in California have not received much support from the United States Supreme Court regarding our Second Amendment rights under the Constitution of the United States of America.
    For years we have not been able to purchase two handguns on the same background investigation form and now California seeks to limit semi-automatic rifle purchases in the same way.
    What is not so humorous is, if a movement by state legislators can happen in one state then that same movement can also spread to other states like wildfire.
    Just saying that we are all fish in the same kettle and the politicians are really turning up the heat.
    Whether California Governor Gavin Newsome is recalled and loses his job will remain to be seen in November of 2020 by ballot but the effect of all the bad laws he passed will remain until they are also removed.

Since there already are a multitude of laws that, if did as the authors intended, should have already done what California intends with this new piece of legislation. But then again, they completely ignore any of the statistics that make a farce of most of their gun control legislation.

      They can not explain why, in Australia, years after bans, thousands more arms get turned in.

      They can not explain the people of New Zealand who openly challenged and refused having their rights to private ownership taken away.

      They can not explain why, in every place in the USA where bans and gun controls have been instituted, many thousands of gun owners have been Civilly Disobedient.

We live in nice private area but they come all time. I hope when you work 60+ hours a week and someone cleans you out and your insurance is canceled and your family is not able to pick up & move to even higher rents youll be able to exercise your right to protect yourself and property. Come up here and sit on hold w 911 for an hour and hope someone in your neighborhood is armed cuz believe me no else is coming! our power goes out all time weve been evac due to ca fires and everytime we get punks looking for opportunities and yes they are dangerous w crowbars and knives ass prying instruments and weapons. Maybe it prevents an unscrupulous but otherwise vetted gun buyer from purchasing multiple rifles simultaneously and then selling them at a profit to criminals, etc., then merely reporting them as stolen. That’s a pretty lucrative business in certain areas that occurs more often than people care to admit to.
    As always, merely my thoughts & your mileage may vary.

      Michael, it is not unusual for a collector to come across multiple items for sale thru an auction or a private transaction. Most collectors have an ATF license to obtain these items. It would appear that in California, you can only purchase one such collectible item each month. Why? To what purpose? Semi-automatic firearms date back to the late 1800’s (e.g. Broomhandle handgun). Further, I would appreciate your proof that straw purchases “occur more often that people care to admit to”.

      Michael B. Are you not aware that what you illustrate is already a very serious felony? Are you not aware that almost ZERO percent of guns used in crimes are purchased by straw buyers? The scenario you portray of people buying new guns, selling them, then reporting them as stolen, is a very rare, almost-never, occurrence. Your comment to the contrary only shows that you know how to fabricate a tale.

      Name for me some of these “often” occurring instances, where this exact thing has been proven to have been done. I will be waiting.

On the background check states “Are you buying this gun for your own personal use?” You start buying several of these and report them stolen, lost or sell them. Won’t be long before you loose your right to buy. That questions arebask for a reason. To prevent such from happening. ATF sees a pattern of this your going to jail. You loose your right to own. Most people fear loosing this right as much as the plague. Dumb Ass

It won’t change anything until the Bay Area and SoCal burn or until CA splits into multiple states. But that’s a fantasy which is likely to never materialize.       CA has been leftist for several decades, probably since the early 1970s. It especially worsened after Tom Bradley became mayor. To be sure, the inner city started to have problems in the mid 50s but the surrounding cities near downtown began collapsing in the early to mid 70s. I don’t know when Virginia became blue but I don’t think it became blue a long time ago like CA.

    Gun owners need to mobilize. The social movements in America that have successfully rallied support in the last 100 years did so by pressuring the media, the legislature and even the courts. Never has there been a time like the present. People like Newsom have to be stopped from violating our rights. California voters are the first in line–their failure to do so will make it very hard for the rest of us to aid them. President Trump has completely reshaped the 9th Circuit with excellent new judicial appointments. The environment has never been better for putting jerks like Newsom in his place.

      The criminals don’t bother with purchasing guns legally. They burglarize your neighbor’s house (because they know by one look at you that you have no guns) and take all his guns. Evil exists. The only way to stop a bad guy with a gun is with a gun. A bad guy includes a tyrannical government that strips away my right to defend myself.
